1.0 End User License Agreement

THIS IS A LEGAL AGREEMENT (THE “AGREEMENT”) BETWEEN YOU, YOUR FIRM, LICENSEE, YOUR CLIENT, PURCHASER (IF ANY), AS THE CASE MAY BE (COLLECTIVELY “LICENSEE”)
AND MAHASHANKH Firm, A firm Register with GSTIN 10CPUPC7261L1ZN Legal Name OM PRAKASH CHAUDHARY, Trade Name, MAHASHANKH, placed in Ground floor, SP. chaudhary 01, DINMANPUR KHAIRI ROAD, KHAIRI TOLE KHARAJ, Samastipur, Bihar, 848117 , HEREINAFTER REFERRED TO AS “MAHASHANKH”.
THIS AGREEMENT APPLIES TO ALL THE LICENSES ISSUED VIA THE WEB AND VIA LOCAL SALES REPRESENTATIVES, AND IS APPLICABLE TO ONLINE DELIVERY OF THE LICENSED MATERIAL. BY ORDERING A LICENSE, LICENSEE, DESIGNATED END USER AND PURCHASER, IS CONFIRMING THAT IT HAS CAPACITY TO ENTER INTO A CONTRACT UNDER ITS LOCAL LAWS.

This agreement applies to all users who purchase or obtain designs online through WWW.MAHASHANKH.COM

If any customers buy any design & that design is not same that shows in thumbnails In case of different ( SIZE Or in place original design change by other design has given to customer )then customer have to inform us by email : [email protected] within 24 hour. Then company reply on report mail then after within 48 hour we will provide them original design by email or website link. If we unable do provide original design, then we will return his money within 10 day working hours.
If customer has not report us on email: [email protected] about their change design within 24 hour then customer have to keep that design.

What is Mahashankh Dedicated Design ?

Mahashankh Dedicated Design is a premium service offered by Mahashankh, a company specializing in digital pattern and surface design. This service is tailored for clients who have a specific vision for their project and seek to buy Readymade patterns and surface design(s) that is Available On Mahashankh.com.

Dedicated Design means a single design sold to single customer, on that design that customer has exclusive rights.

Note-When you select and pay for a design, the following terms and conditions typically apply from that point in time:

Terms and Conditions For Dedicated Design Only:

• Exclusive Design: Once a design is purchased, it becomes the permanent, lifetime property of the customer. Each purchase applies to an individual design or design bundle, with files available for download once payment is confirmed on Mahashankh.com.
• Every design available on Mahashankh.com is the original digital creation of the Mahashankh Designer team. Utilizing these designs without proper payment constitutes an illegal act, and violators may be subject to stringent legal consequences in accordance with local government laws.
• Legal Protection: The purchase becomes a legally binding contract, protecting both the buyer and the seller.
• Once you complete the purchase and download a design from Dedicated Design Categories, it will be removed from our platform within 72 hours to protect your exclusive rights.
• Taxes are applicable and will be charged additionally.
• Downloaded videos/designs cannot be returned or replaced.
• The downloaded designs/videos can be used for lifetime.
• The downloaded designs/videos are provided under a Royalty-Free License.
• Unlimited usage is permitted in print, advertising, packaging, and merchandising.
• Personal and Commercial Use: Customers are allowed to use designs for both personal and commercial purposes, including resale, sublicensing, and distribution without any restriction . 
• Please read again the End-User License Agreement for usage guidelines regarding the designs/videos.

1. Exclusive Design: Once a design is purchased, it becomes the permanent, lifetime property of the customer. Each purchase applies to an individual design or design bundle, with files available for download once payment is confirmed.

2. The designs fall under the MAHASHANKH DEDICATED DESIGN category.

3. Modification Rights: Upon completion of payment, customers are entitled to download the design and begin utilization. They possess complete authority to modify the design, including altering dimensions, colors, aspect ratios, or incorporating it with other designs to suit their specific needs.

4. Fair Use Rights: Customers are entitled to incorporate Mahashankh Design alongside other branded designs for legitimate purposes, in accordance with fair use provisions.

5. Customers are granted unrestricted rights to use the designs in any religious setting, including temples, mosques, churches, gurudwaras, or other places of worship, for decorative purposes..

6. Should a customer notice any blurriness or perceive a portion of the design as missing, this should not be regarded as a defect. Instead, it is considered an intrinsic aspect and characteristic of the design’s aesthetic.

All designs are exclusively created by MAHASHANKH and are accessible through the websites www.mahashankh.com and www.design.mahashankh.com, as well as any subsection of www.mahashankh.com.

Mahashankh Shared Design is a service that allows multiple customers to purchase the same design at an affordable price. While the copyright for the design remains with Mahashankh, customers are free to use the design for their own purposes. It’s a great option for those seeking unique and cost-effective design solutions.

• MAHASHANKH SHARED DESIGN is service offered by Mahashankh.com.
• Every design available on Mahashankh.com is the original digital creation of the Mahashankh Designer team. Utilizing these designs without proper payment constitutes an illegal act, and violators may be subject to stringent legal consequences in accordance with local government laws.
• Legal Protection: The purchase becomes a legally binding contract, protecting both the buyer and the seller.
• Taxes are applicable and will be charged additionally.
• Downloaded videos/designs cannot be returned or replaced.
• The downloaded designs/videos can be used for10 year period or lifetime ( Mention in below design description).
• The downloaded designs/videos are provided under a Royalty-Free License.
• Unlimited usage is permitted in print, advertising, packaging, and merchandising.
• The customer is prohibited from reselling, sublicensing, or distributing the design.
• The downloaded designs/videos have an Exclusive License with some restrictions.
• Customer Can Customize this design according to their uses but any pieces of design they can not claim design was created by him nor resell it as his work [design/media].

PARTS OF DESIGN

Below all Terms and condition and instruction are applied on both Dedicated Design & Shared Design.

1. The “©️MAHASHANKH” mark displayed on the design thumbnails serves as a watermark. It is not an element of the actual design but is used for the purpose of protecting the design against unauthorized use or duplication.
2. The presence of blur in any area of the design—whether it be the corner, side, middle, or elsewhere—is not considered a flaw. It is an intentional feature that contributes to the overall uniqueness and beauty of the design.
3. Curved lines, dots, and various other structures that appear on the design, whether viewed with zoom or without, are all integral elements of the design’s convertible pattern.

This End-User License Agreement (“EULA”) is a legal agreement between you and MAHASHANKH.

This EULA agreement governs your acquisition and use of our MAHASHANKH DESIGN (“design”) directly from MAHASHANKH DESIGN on www.design.mahashankh.com. (for Shared Design) & MAHASHANKH on www.mahashankh.com. (for Dedicated Design).

Please read this EULA agreement carefully before completing the buy & uses process of the MAHASHANKH design. It provides a license to use the MAHASHANKH design and contains uses information and liability disclaimers.

If you register or sign in for a buy of the MAHASHANKH design, this EULA agreement will also govern uses of Both DEDICATED DESIGN & SHARED DESIGN. By clicking “accept” or buy and/or using the MAHASHANKH design, you are confirming your acceptance of the design and agreeing to become bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not buy or use the design, and you must not accept this EULA agreement.

This EULA agreement shall apply only to the designs supplied by MAHASHANKH herewith regardless of whether other designs is referred to or described herein. The terms also apply to any MAHASHANKH updates, supplements, Internet-based services, and support services for the design, unless other terms accompany those items on delivery. If so, those terms apply.

License Grant through End User License Agreement

MAHASHANKH hereby grants you a personal, non-transferable, non-exclusive or Exclusive license to use the MAHASHANKH design on your devices in accordance with the terms of this EULA agreement of the product.

You are permitted to buy the MAHASHANKH design (for example a web, textiles, Fashion, tiles, wallpaper , Interior Design, Product Cover, templates, print media, decoration or personal & commercial uses ) under your control. You are responsible for ensuring your device meets the minimum requirements of the MAHASHANKH design.

You are permitted to

• Edit, convert(change multi pattern & colour of design) , modify, otherwise change the any part of the design & permit the whole or any part of the design to be combined with or become new pattern in any other design.
• The customer is prohibited from reselling, sublicensing, or distributing the design.
• Allow any third party to use the Software on behalf of or for the benefit of any third party
• Do not use the design in any way which breaches any applicable local, national or international law
• Use the design for any purpose that MAHASHANKH considers is a follows of this EULA agreement.

Intellectual Property and Ownership

MAHASHANKH shall at all times retain ownership of the design as originally downloaded by you and all subsequent downloads of the design by you. The design (and the copyright, and other intellectual property rights of whatever nature in the design, including any modifications made thereto) are and shall remain the property of MAHASHANKH .

MAHASHANKH reserves the right to grant licences to use the design to third parties.

Termination

EULA agreement is effective from the date you first use the design and shall continue until terminated. You may terminate it at any time upon written notice to MAHASHANKH .

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Laws

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of in.
